What is Wynyard Estate Services?
Wynyard Estate Services is a property management company to facilitate the maintenance and upkeep of the communal areas of the Wynyard Estate.
Do Wynyard Estate Services make a profit?
Wynyard Estate Services is a not-for-profit company and all revenue is reinvested back in to the running of the estate with any float being identified and ring fenced for future maintenance, equipment and improvement to the estate.
What is provided as part of the 24 hour security?
- 24/7 security guards who conduct night time patrols.
- Vehicle recognition at all vehicle entry points into the estate.
- CCTV cameras at key points throughout the estate.
- The camera network will be extended through the new build areas along the main road infrastructure.
Security guards are there as a deterrent and don’t have the powers to make an arrest or detain. Your first point of call should be 999 if there is an emergency, then make our security team aware of the incident.
The security team are here to help and assist where possible, monitor the CCTV and collate the information to pass on to the relevant emergency service. The Wynyard Estate continues to be a safe place to live and we are proud to uphold a 0% crime rate in the area with little to no actual offences committed.
Who is responsible for gritting the roads and paths?
Any adopted highways are the responsibility of the local authority to maintain which includes salting and gritting. Hartlepool does not provide any gritting services and Stockton will only cover the main spine road (The Wynd). All other areas are picked up by Wynyard Estate Services.
Why is there no sequence for grass cutting?
All adopted verges are the responsibility of the county council. Hartlepool have been contacted on numerous occasions but do not provide any grass gutting. Stockton will cut the grass on a fortnightly basis, but the date is dependent on weather and programme. Wynyard Estate Services will provide a weekly cut to the village areas and a fortnightly cut to all other areas not adopted or covered by Stockton council. You may see from time-to-time Wynyard Estates cutting grassed areas which are adopted if they are looking unsightly or there are delays from the county council.
Who is responsible for replacement street lights?
All street lights are adopted by the local council and it is their responsibility to maintain them. Wynyard Estate Services are responsible for the replacement lamp heads and cover plates as these are non-standard and bought from the council for fitting by their engineer.
Are there public rights of way through the Wynyard Estate?
There are no public rights of way through the Wynyard Estate. All non-adopted areas are privately owned. Cameron Hall Developments allow access over these areas for public use but can be stopped at any time without prior notice.
Rent Charge Enforcement - s121 of the Law of Property Act 1925
An estate Rentcharge can be enforced using various remedies, including the statutory remedies set out in s.121 of the Law of Property Act 1925. In simple terms such remedies include (where the Rentcharge is unpaid for 40 days after it is due), the right for the Rentcharge owner to enter into possession of the property and take the income from the property until the rent and all arrears have been paid and also the right to grant a lease of the property and recover the rent.
In recent years, mortgage lenders have become concerned about such remedies and how they could impact upon the value of the property. As a consequence WES has received requests from property owners to formally vary the Rentcharge, to remove the s.121 remedies. WES has confirmed that subject to the legal costs of entering into a formal deed of variation being met by the property owner, then such a deed of variation is acceptable. To date, deeds of variation have been entered into with various property owners within the estate.
When individual properties are registered at the land registry, the land registry make a note to the effect that the property is subject to the Rentcharge.
Separately, WES apply to the land registry to register their interest, as the Rentcharge owner.
The Rentcharge titles are already registered for parts of Wynyard, being those parts that were developed first, for example around the village centre. The registration of the Rentcharge titles for other parts of the estate are ongoing at the land registry
Can I access Wynyard Hall grounds and use the Estate road as a short cut from the village?
Wynyard Hall is a privately owned estate which operates as a wedding & event venue, restaurant, café and visitor attraction and relies solely on revenue from paying customers to maintain the Grade II listed building and historic parkland which surrounds it. Wynyard Hall encourages all residents to use the facilities on your door step and offer various discounts across the estate to residents. Dogs are welcome in The Glass House, Gardens and café but must always remain on a lead for public safety. Wynyard Hall is an independent business and offers a service to its customers that should not be undermined by residents using it as a cut through the estate or for dog walking/running trails. The estate road that runs from the Golden Gates to the Kennels is a private road only for use by customers and employees of Wynyard Hall. This road is not designed for the traffic that is currently using it as a short cut through Wynyard Hall and cannot sustain this amount of traffic. We ask that all residents to respect this and help us protect the historic asset at the heart of the Wynyard Estate.
Does the service charge pay for the maintenance of Wynyard Hall?
No element of the Wynyard Estate service charge is used to maintain any of the Wynyard Hall grounds. Wynyard Hall employ and salary 5 groundsmen that look after the commercial rose garden and maintain all of the parkland independently of Wynyard Estate Services.
If I live in a new build property, who is responsible for the maintenance while the site is under construction?
If you live in a new build home and the phase or development is not complete, it is the responsibility of the house builder to maintain the soft landscaped areas while they are on site unless otherwise agreed with Wynyard Estate Services.
What is the policy on making modifications to garden rooms or requesting to build garden rooms?
All alterations/modifications are to be approved by Wynyard Estate Services. You are required to send full details of the planned works by post or email.
A fee is payable up to £120.00 incl VAT depending on the size of the project.
Who do I notify that I'm selling my property?
As part of the selling process, your solicitor should inform us, in writing, of an impending change in ownership of your property. As much notice as possible is helpful, and at least ten working days before the sale. Please refer to a copy of the deed of covenants & release. Available on the link below.
